TERMS OF USE
ForNeedy Crowdfunding Platform
Welcome to ForNeedy. These Terms of Use (“Terms”) govern your access to and use of the ForNeedy crowdfunding platform, website, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of the Services. ForNeedy reserves the right to modify these Terms at any time without prior notice. Continued use of the Services after any changes constitutes acceptance of the revised Terms.
1. Eligibility
1.1 The Services are available to: Individuals who are at least 18 years old or of legal age under applicable law; and Legally registered organizations, including non-governmental organizations (NGOs).
1.2 ForNeedy may require submission of identification documents, organizational registration certificates, or other supporting documentation to verify eligibility.
1.3 ForNeedy reserves the right to suspend or terminate any account or campaign if: Fraudulent, misleading, or suspicious activities are detected; Complaints are received from credible sources; or There is a violation of these Terms or any applicable law. Such action may be taken with or without prior notice.
2. Account Registration
2.1 To access certain features of the Services, users must create an account.
2.2 You agree to: Provide accurate, complete, and current information during registration; Maintain and promptly update your information; Safeguard your login credentials.
2.3 You are solely responsible for all activities conducted under your account.
2.4 If you suspect unauthorized access to your account, you must notify us immediately at info@forneedy.com. ForNeedy shall not be liable for any loss or damage arising from unauthorized use of your account.
3. Creating a Campaign
3.1 Individual Campaigns; Individuals are permitted to create fundraising campaigns for their own personal needs only. An individual may not create a campaign on behalf of: Another person, A group of individuals, or An organization unless proper written authorization and supporting documentation are provided and approved by ForNeedy. The individual campaign creator is solely responsible for: The accuracy of information provided; The legitimacy of the fundraising purpose; The proper use of funds raised
3.2 NGO and Organization Campaigns; Registered NGOs and legally recognized organizations may create campaigns for the benefit of the community or specific beneficiaries consistent with their organizational objectives. Organizations must ensure that: Funds are used strictly for the stated charitable purpose; All representations made in the campaign are truthful and accurate; Necessary approvals, permits, or regulatory compliance requirements are met. ForNeedy reserves the right to request additional documentation at any stage before, during, or after a campaign is published.
3.3 Campaign Obligations; All campaign creators agree to: Provide truthful, accurate, and complete information; Clearly state the fundraising goal and intended use of funds; Upload supporting documentation when requested; Use the funds solely for the purpose described in the campaign; Comply with all applicable Malaysian laws and regulations. ForNeedy does not guarantee the success of any campaign.
4. Publication and Review of Campaigns
4.1 All campaigns are subject to review and approval prior to publication.
4.2 ForNeedy reserves the right, at its sole discretion, to:
Reject, edit, suspend, or remove any campaign content; Request additional information; Terminate campaigns that violate these Terms.
4.3 Campaign creators bear full responsibility for the content they publish. For assistance, please contact info@forneedy.com.
4.4 ForNeedy is not responsible for marketing or promoting any campaign unless the campaign creator subscribes to ForNeedy’s Marketing Services. For inquiries, contact info@forneedy.com
5. Fees and Payment of Donations
5.1 All campaigns are subject to a 10% service fee, which includes administrative and payment processing charges.
5.2 Funds will be transferred to the Campaign Creator within fourteen (14) days after: Successful completion of the campaign; or A valid withdrawal request.
5.3 Transfers may take up to thirty (30) days or longer in cases involving: Violations of these Terms; Legal or regulatory review; Inaccurate information; Disputed or suspicious transactions.
5.4 Campaigns receiving donations from outside Malaysia may experience additional processing delays.
5.5 The minimum amount for advance withdrawal is RM500. ForNeedy reserves the right to retain funds until the minimum threshold is reached.
6. Privacy and Personal Data
6.1 By using the Services, you consent to the collection, processing, and storage of your personal data in accordance with applicable laws, including Malaysian data protection regulations.
6.2 ForNeedy will not sell or share your personal information with third parties without your consent, except: As required by law; To comply with regulatory obligations; To prevent fraud or unlawful activities.
7. Limitation of Liability
ForNeedy acts solely as a technology platform connecting campaign creators and donors. ForNeedy does not guarantee: The accuracy of any campaign; The delivery or outcome of any funded project; That funds will be used as intended by the campaign creator. ForNeedy shall not be liable for any direct, indirect, incidental, or consequential damages arising from use of the Services.
8. Termination
ForNeedy reserves the right to suspend or permanently terminate access to the Services at its sole discretion if a user violates these Terms or engages in unlawful activity.
